Terms and Conditions

The following contract below, will commence between Lettuce Know Logistics ltd and the customer, any information or advice and services supplied by Lettuce Know Logistics will be subject to the conditions stated below.

1.0 Terms of use for Lettuce Know Logistics website

1.1 By accessing, using and downloading any materials from our website you agree to follow and be bound by Lettuce Know Logistics terms and conditions. If you do not agree to the terms on this website don’t use the website and just contact us alternatively.

1.2 Any information provided on this website should only be taken as an introduction to Lettuce Know Logistics range of products and services. We do not, or any third parties provide any guarantee or warranty on the performance, accuracy, timeliness, completeness or suitability on the material or information you will find on Lettuce Know Logistics website and other online content. 

1.3 The content on these pages is subject to change without notice and is for general information and use only.

1.4 You are responsible for making sure that any third party products or services you subsequently purchase or engage with, as a result of the information you have read on this website, meets your own specific needs and requirements.

2.0 Limitations and Liability:

2.1 Lettuce Know Logistics has its own legal jurisdiction to follow as a certified Transport Service License (Goods and services license) here in New Zealand.

2.2 It is the responsibility of the customer to ensure that any permits, documents or licenses in regards to the move are completed prior to the job commencement. These may include but are not limited to temporary road closures or traffic control measures in order to complete the job.

2.3 Respect and care are the core values of Lettuce Know Logistics but we acknowledge that carrying out such tasks in small areas with fragile items it is not an impossibility that a risk exists for marks/scuffs to items, door frames, internal walls, tiles and flooring. The risks are low and Lettuce Know Logistics will be reducing all risks associated with each lift. However all work carried out either loading or unloading will be carried out at “owners own risk”

2.4 Lettuce Know Logistics trucks are up to 6m in total length and can weigh more than 7 tonnes fully laden. This poses risk to the property where the job is taking place and also the truck itself. Particularly note that any damages caused by our vehicle to driveways, footpaths, underground services (electrical, plumbing) and lawns. Drivers will maneuver with good intent however if damage is accidentally done and the driver has not been forwarned by the client of potential risks then the company or its insurers will not be held accountable. Such responsibility will fall directly on the owners or acting owners of the property.

3.0 Loading/Unloading

3.1 If Lettuce Know Logistics is being held up with its operations due to repacking or insufficient packing that is posing a risk to property, ie glasswares or pot plants packed in a way destined to break, then Lettuce Know Logistics reserves the right to charge for wasted time to repack or decline taking these items. Responsibility will therefore fall on the client to get these items to the destination.

3.2 Customers will not give Lettuce Know items which are deemed as unsafe. These include: flammable or corrosive items, items deemed as dangerous or explosive, items that could have catastrophic results on other items being moved in the truck for instance paint buckets and tins. Anything likely to create an issue of vermin, pests or insect infestation, stolen goods or prohibited items by law, animals or pets caged or uncaged, or frozen or refrigerated food.

3.3 Lettuce Know Logistics reserves the right to refuse the carriage of precious items such as deeds, money, stones and metals, watches and personal jewelry or precious collections. We advise these items be moved by the owners in their own secure mode of transport. 

4.0 Access

4.1 For all furniture relocation services and or general freight logistics services whereupon the quote has been obtained by information supplied by the customer, Lettuce Know Logistics reserves the rights to modify or change prices as a result of incorrect information supplied. These will include items that have not been disclosed, that are of larger volume or dimension. Additional charges may also be incurred if there is one or more pick up or drop off location or if there is a redirection or unforeseen labor not within original scope of work. 

4.2 It is the customer's obligation to notify Lettuce Know Logistics before the move takes place of any access issues that exist or could arise, as this ensures that all aspects of the entirety of the move are considered. Topics to consider: tight stairwells, on or off road parking, can the truck be at a level position when being loaded, trees or power lines that may limit access. Failure to do so could result in additional charges or inability to complete the move in which case the customer would still be charged. 

4.3 It is the customer’s responsibility to ensure that items will fit in the new premises (eg: size of sofa and size of aperture). We will not remove doors or windows in such cases and it is up to the customer to organize a specialist if needed.

5.0 Loss or damage

5.1 Lettuce Know Logistics operates under “at owners risk” unless otherwise stated on a contractual agreement - so it's important you make arrangements for contents insurance directly with an insurer. There is an exception for intentional damage. If the carrier or an employee intentionally damages or harms your goods, they're liable for the full cost no matter what type of contract you have.

5.2 Standard contents policies don't cover your goods during removals by a third party, so you'll need extra cover when you're moving house. 

6.0 Payment and Pricing

6.1 Jobs will only be confirmed once deposit has been paid (excluding WINZ and Kaianga Ora jobs and commercial business contracts).

6.2 An invoice will be sent to the client following the service for the payment minus the deposit already paid. Clients will be given 3 days to make payment from the date the invoice is sent.

6.3 The price of service is as advertised on the company website unless otherwise agreed apon prior to service taking place.

6.4 15% of invoice fee applies to any invoices not paid by due date. 

6.5 Payment Methods: Payment can be made by Internet Banking only.

6.6 All defaulting accounts will be passed onto third party debt collection agents at the customer’s expense. 

6.7 On quoted jobs you may incur extra charges if the actual amount of items on the day exceeds the amount of items that were included in your quote, if you have under-estimated your items by accident as we understand this can happen we reserve the right to add on an extra charge depending on the amount and size of items and time taken to load them. If you have grossly under-estimated or have been misleading about the amount, size or type of items you have, we have the right to refuse the extra items regardless of whether you are willing to pay extra charges

6.8 If cancelling a job, the amount of the deposit is still billable and non-refundable if a job is cancelled less than 48hrs prior to the initial pick-up time. If a booking is cancelled before 48hrs prior the full amount is refundable.

7.0 Staff 

7.1 Breaks: Our break times are flexible but will be within the law, the standard amount that most work groups adhere to is 10 min for a cuppa and half an hour for food. These are up to the operator to decide on, not the client.

7.2 Wait times. Time is money and any time wasted and deemed to be at the fault of the customer due to items not being ready to load, customer not present at agreed location, vehicles or other items to be moved that are in the way of the proposed lift will be charged at the standard hourly rate quoted for the job. These conditions are applied at both ends of the job quoted.

7.3 Threatening or abusive behavior towards or in the presence of staff will not be tolerated at all and Lettuce Know Logistics has the right to leave the premises in these instances. The customer will be liable to pay in full.

7.4 If in the quoting process you agreed upon it is your responsibility to help the driver load and unload or to provide a suitable person(s) to do so. If the customer or suitable person has agreed to assist with the job, please ensure you are physically fit and able to partake in the work. Lettuce Know Logistics accepts no responsibility for any injury or other physical problems that occur as a result of assisting with the job. Please ensure you only assist with the job if you are physically capable of doing so. If you said you would help then don't for some reason Lettuce Know Logistics reserves the rights to refuse the job at customers full expense.

Acceptance

Confirmation of your booking with Lettuce Know Logistics services will form a contract for service subject to the above Terms and Conditions.
